"Citizenship and immigration lawyer Joel Sandaluk said while it’s true the government is within its rights to revoke passports, the apparent secrecy surrounding the decisions is troubling.

“The thing that’s curious about this is, it’s not exactly all that clear on what information the government is basing these revocations,” he said. “The government is asking us to place an extraordinary amount of faith in their ability to operate.”

"Canada’s anti-terrorism laws do not violate the constitutional rights of those suspected of furthering terrorist acts, the Supreme Court of Canada has ruled.

The landmark ruling means that an Islamic terrorist from Ottawa – Mohammed Momin Khawaja – will spend his life behind bars for aiding a violent jihadist group based in England.

It also paves the way for the extradition of two other Ontario men wanted in the U.S for helping acquire arms to be used by Sri Lankan terrorists."

Canada’s anti-terror law upheld as top court dismisses three appeals

"Canada’s anti-terrorism laws withstood an important legal challenge Friday when the Supreme Court dismissed the appeals of three Ontario men who had argued the provisions should be struck down.

The high court justices unanimously rejected claims the 10-year-old terrorism sections of the Criminal Code had defined terrorist activity so broadly they threatened free expression and were therefore unconstitutional.

In related decisions, the court gave its stamp of approval to a wide definition of terrorism that recognizes terrorist activity goes well beyond planting bombs and includes anything intended to “enhance” a terrorist group."

"The Federation of Law Societies of Canada is recommending in its first-ever set of national standards for admission to the bar that all new Canadian lawyers possess knowledge of aboriginal rights.

Approved over the weekend in Vancouver, the move by the federation - the coordinating body for Canada's 14 provincial and territorial law societies - is part of a push to ensure Canada's lawyers are knowledgeable in aboriginal law, an area that some legal experts say is becoming more important and plays into everything from natural resources development to drafting or changing government policies.

Aboriginal law is the law relating to the content and application of the constitutional protection of aboriginal and treaty rights that was affirmed in the 1982 Constitution Act."

That should just about do it.

Regina lawyer Tony Merchant makes “patently bad decision”

"Tony Merchant “purposely” formulated and executed a plan intended to thwart a court order, says a decision finding the Regina lawyer guilty of professional misconduct.

“None of the member’s (Merchant) actions have done anything to inspire the public’s confidence in the administration of justice or the legal profession,” says a summary of the findings of the Law Society of Saskatchewan’s discipline hearing committee. It was released Tuesday by the law society, the governing body for the province’s lawyers.

Last month, the discipline committee released a decision finding Merchant guilty of two counts of conduct unbecoming a lawyer arising from his handling of a family law matter."

Merchant is notorious for exploiting aboriginal groups, undertaking class action suits, getting his hands on lots of cash from the feds. I'm glad to see he's had his knuckles rapped.  Too bad it wasn't for his exploitation of First Nations groups, though.  But it sounds like he was counseling a client not to pay support due to a divorcing wife. And it's not the first time he's been censured by the Law Society.

Appeal up in smoke, as court says pot’s no sacrament

"The Hamilton-based Church of the Universe – a group that uses marijuana as a religious sacrament — won’t be sparking up with the blessings of the court.

The Church, through its Toronto G13 mission, lost its bid Monday to be exempt from Canada’s pot laws.

It’s the latest defeat the church has had before the courts, including appeals to the Supreme Court of Canada on issues regarding its use of pot and other issues.

Last year, the federal court declined to hear appeals regarding the 2007 marijuana trafficking convictions against church founders Walter Tucker and Michael Baldasaro. In 1992, the Supreme Court refused to hear an appeal by Tucker and his wife, Joanne, of a 1989 provincial court ruling that committed them for trial on drug charges.

Baldasaro, who ran for Hamilton mayor last year, was dismayed by the latest ruling, but said it won’t change their views. The judge said she found church members sincere in their use of pot but she did not think it was possible to create a workable religious exemption."
